Our terms and conditions

TERMS AND CONDITIONS:

i) All goods delivered by NRB Filtration Services (SUPPLIER) to the applicant in terms of verbal or written contract(s) after the date of signature of the Application shall, in addition to such terms and conditions as may be incorporated in contracts, be governed by the terms set out in this Application form to which, by his/her signature, the supplicant acknowledge being bound.

ii) In the event of the terms and conditions incorporated in contracts conflicting with the terms set out in this application form, the terms and conditions incorporated in the contracts will prevail notwithstanding the terms contained in this application form.

iii) Amounts due and payable by the applicant to the supplier, NRB Filtration Services Pty Ltd, in terms of contracts will attract interest, if payment is not effected within thirty days as foresaid, as per National Credit Act No. 34 of 2005.

iv) The applicant consents to the jurisdiction of any Magistrate’s court having jurisdiction in respect of his/it’s person in respect of any legal action which the Supplier, NRB Filtration, may be obliged or be advised to institute against the applicant to recover amounts due payable terms of contract as read with these terms notwithstanding the fact that amount claimed would otherwise exceed the jurisdiction of such Magistrate’s court. The Supplier, NRB Filtration Services, however, reserved the right to institute such proceeding as may be necessary or as it may be advised in any competent division of the Supreme Court of South-Africa. The applicant agrees that in the event of the Supplier, NRB Filtration Services, instituting legal proceedings against it to recover amounts due to it in terms of contract or for the enforcement of other obligations or the recovery of damages owned by the Applicant to the supplier in terms of such contracts, the applicant will be liable to pay to the supplier, NRB Filtration Services Attorney and client costs and collection commission.

v) The supplier, NRB Filtration Services, shall be entitled at any time, without notice to adjust credit limits, or terminate credit facilities granted to the applicant pursuant to the application, and required that the purchase price of goods sold and delivered thereafter by the supplier to the applicant be cash on delivery. The termination of such credit facilities shall not, in any way Prejudice the right of the supplier, NRB Filtration Services, recover amount due to it in terms of contracts concluded prior to the termination of such credit facilities, which contract shall be governed. Inter alia, by the terms and provisions set out in this Application Forms.

vi) The applicant should note that the opening of the applicant’s account by the supplier, NRB Filtration, is done under the following condition. All goods obtained from supplier by the applicant will remain the property of the supplier until fully paid for. Difficulty in obtaining payment for such goods will entitle supplier to repossess those goods at any time.

vii) The applicant accepts the terms, conditions and all procedures as set out in the National Credit Act No. 34 of 2005.

viii) The signatory of the application form warrants that he/she understands these terms and conditions and is duly authorized to make this application and on behalf of the applicant and to bind it to the terms here in contained and furthermore warrant that the information contained in this application is true and correct.
